1. Acceptance of Terms
By downloading, accessing, or using the TechTrust mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. TechTrust AutoSolutions LLC ("TechTrust," "we," "us," or "our") reserves the right to modify these Terms at any time. Continued use after changes constitutes acceptance.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into binding agreements to use this App. By using TechTrust, you represent and warrant that you meet these eligibility requirements.
3. Service Description
TechTrust is a technology platform that connects vehicle owners ("Customers") with independent automotive service providers ("Providers"). TechTrust acts solely as an intermediary and marketplace. We do not perform automotive services and are not responsible for the quality, safety, legality, or any aspect of services performed by Providers.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized access or use of your account.
5. Independent Contractors
All service providers on TechTrust are independent contractors, not employees, agents, or representatives of TechTrust. TechTrust does not supervise, direct, or control service providers' work. Any warranty or guarantee on services is the sole responsibility of the Provider.
6. Payment Terms
TechTrust uses a pre-authorization payment model. When you accept a quote, a hold is placed on your payment method for the quoted amount plus applicable fees. The actual charge is only captured after you review and approve the completed service. A 10% platform fee and payment processing fees (varies by processor) apply to each transaction and are visible before you confirm. Payment processing is handled by secure third-party partners (e.g., Stripe).
7. Cancellation Policy
You may cancel a service request at no cost before accepting a quote. After accepting a quote: cancellations made more than 24 hours after acceptance are subject to a 10% cancellation fee; cancellations made within 24 hours of acceptance are subject to a 25% cancellation fee. Once service has started, cancellation requires Provider validation and may be subject to charges for work already performed.
8. Electronic Communications Consent
By using the App, you consent to receive electronic communications from TechTrust, including push notifications, emails, and in-app messages regarding your account, transactions, service updates, and promotional offers. You may opt out of promotional communications at any time through your account settings.
9. Disclaimer of Warranties
THE APP AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TECHTRUST SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHTRUST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TECHTRUST'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID THROUGH THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless TechTrust AutoSolutions LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.
12. Binding Arbitration & Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the State of Florida. YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Each party shall bear its own costs, and the arbitrator's decision shall be final and binding.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Florida.
14. Force Majeure
TechTrust shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, internet or telecommunications failures, or acts of third parties.
